Power failure disrupts Sodomy II or to avoid further embarassement

Electricity supply to the packed court room was disrupted soon after the fifth witness took his oath.

KUALA LUMPUR: The sodomy trial of Opposition Leader Anwar Ibrahim was disrupted due to a power failure at the Jalan Duta Court Complex here today.

The power failure occurred about 11am, soon after the prosecution’s fifth witness, Dr Seah Lay Hong, of the Chemistry Department took the oath.

Earlier, Kuala Lumpur Hospital Emergency Care Specialist Dr Khairul Nizam Hassan testified that he did not fill up several key medical information on the “pro-forma form” when he examined Mohd Saiful Bukhari Azlan.

He agreed with leading defence counsel Karpal Singh that among the information he had omitted were the sexual history of the complainant, physical examination, circumstances leading to the incident and whether the victim had washed his mouth after the alleged “oral sex”.

When he was referred the pro-forma form by Karpal, Khairul agreed that there was no force used during the act.

However, he said the patient (Mohd Saiful) had informed him that he had put up some resistance.

Anwar, 63, the Permatang Pauh MP, is charged with sodomising Mohd Saiful, 25, at Unit 11-5-1 of the Desa Damansara Condominium, Jalan Setiakasih, Bukit Damansara between 3.01pm and 4.30pm on June 26, 2008.

Questioned further by Karpal, Khairul explained that the form was just a guide in recording the patient’s history, adding that in this particular case, Mohd Saiful had clearly told him that he was sodomised and asked to perform oral sex by a high-profile figure.

To another question, Khairul admitted that prior to preparing his report on July 13, 2008, he had already read the chemistry report received by his department, two days earlier.

However, he said at that time, he was unaware of the actual spots where the four specimens were taken.

“Only after being informed of the presence of semen on swabs B5, B7, B7 and B9 and his actual location during examination-in-chief, I confirmed there was penetration,” said Khairul.

The specialist denied he had contradicted himself in court by going against what he had stated in the report prepared, together with two other hospital specialists, Dr Mohd Razali Ibrahim and Dr Siew Sheue Feng.

The doctors in their reports had stated no conclusive clinical findings on penetration to the anus and no significant defensive wounds on the patient’s body.
