Re: (1) Refusal of the ISA in Taiping to hand over diabetic medicine to ISA detainee P.Uthayakumar.
(2) Refusal of ISA Prison Director to allow P.Uthayakumar to meet him urgently to facilitate in sorting out court matters
We act for Mr. P.Uthayakumar who is currently detained without trial at Kemunting Prison under the Internal Security Act for a period of two (2) years.
Our client instructs us that about two (2) months ago his diabetic medicine Diamicron and Glucophage which was supposed to be handed over to our client and handed over to the Taipng prison UKP chief, Chief Inspector Ayob by our client’s family went “missing”. A report was made to the Taiping Prisons (Ketua) Director Mr. Yasuhimi but to no avail. Our client is now unable to take his medication.
Last Thursday 13/03/2008 our client’s lawyer Ms Santha Devi Velusamy handed over our client’s diabetic medication to En. Shaharam but our client never received the same. A request was made in writing to the Prison Director Mr. Yasuhimi on 17/03/2008 and still to no avail. Then on 18/03/2008 our client was referred to the prison’s clinic hospital assistant (H.A.) (and not a qualified doctor) who wanted our client to take some other medication. The said H.A. informed our client that the Prisons Director Mr. Yasuhimi refuses to hand over our client’s medication to our client.
Please take notice that you are to hand over to our client his medication within 48 hours from the date hereof failing which our client shall hold you responsible for all health consequences our client may face.
Our client also wishes to place on record that despite six requests over the past six weeks seeking an urgent appointment with the Prison Director Mr. Yasuhimi with the view to facilitate sorting out court matters which our client has to attend, as his staff has left his legal firm, the said director has refused to meet him. During the visit of Dato Dzulkifli the Deputy Director General of Prisons and in his presence our client again personally asked the said director to meet him as per the request form and he said later. Our client’s request for monthly check up has not been approved.

Note: The previous clinic medical doctor Dr Subramaniam is believed to have been terminated as he allowed our client to be referred to the Taiping General Hospital for admission when our client was on hunger strike at the end of January 2008.
