The Dewan Rakyat today rejected an emergency motion by DAP to debate the denial of entry to Pakatan Rakyat assemblypersons into the Perak Darul Ridzuan complex to conduct an emergency state assembly sitting on March 3.
The motion, filed DAP's Taiping MP Nga Kor Ming last week, was rejected by Speaker Pandikar Amin Mulia in chambers.
"The speaker rejected the motion because the action of the executive and police officers in halting the 27 Perak state assembly representatives from entering state assembly is being heard in court and there is no decision on the matter yet," said the MP.
"This is wrong and very disappointing... it is as though the executive is allowed to desecrate the state assembly and misuse its powers by using violence to stop the state's representatives from upholding the rights given to us by the people," he added.
Nga, who is also the Pantai Remis assemblyperson, filed the motion alleging that the state secretary and the police went overboard in stopping Pakatan Rakyat state representatives and assembly speaker V Sivakumar from entering the state secretariat building.
It could happen in Parliament as well
He reiterated that Pandikar's rejection was wrong because "the executive's action in stopping the representatives was not brought up in any court cases."
"If the state secretary can simply lock the doors of the state assembly and he or she is not stopped from doing so, this is an embarrassment for the assembly and a dangerous precedent to the legal institution and to the doctrine of separation of powers," he said.
"This is a breach of section 124 of the Penal Code which states: 'Whoever with the intention (...) to compel (...) or refrain a member of Parliament or of any legislative assembly or of any state executive council from exercising in any manner the lawful powers of such member (...) shall be punished with imprisonment for a term which may extend to seven years, and shall also be liable to a fine'," he added.
Nga said a similar incident could also happen in Parliament in future.
The DAP leader stressed that he would continue to prioritise the issue so that the "embarrassing episode" does not recur.
