Chemist Refuses To Answer Some Questions

The Anwar Ibrahim sodomy trial continues today at the Kuala Lumpur High Court with the cross-examination of chemist and DNA specialist Dr Seah Lay Hong.

Lawyer Ram Karpal Singh is expected to finish the cross-examination by mid-day and this is followed by re-examination by the prosecution.

The court had heard many technicalities on how DNA tests are conducted and how it is determined. More of this is expected today as another chemist is expected to testify.

The court has not been filled to its maximum capacity of 70 people as on the average about 60 people including journalists are in court.

LIVE REPORT

8.35am: Anwar arrives with wife and PKR president Dr Wan Azizah Wan Ismail.

8.53am: Defence counsels Sankara Nair, Param Cumaraswamy and Ram Karpal Singh arrives. Aussie DNA specialist Dr Brian Mc Donald is seated between them.

9.01am: Hearing begins with Justice Mohamad Zabidin Mohd Diah presiding.

9.13am: Seah said the maximum number of alleles (number of repeat units) on swab marked as exhibit B5 (the peri-anal area) is four and this indicates that the swab contained DNA from more than two person.

She explains peri means “round” and it is the region around Saiful’s anus.
9.40pm: Seah said she did not do any statistical evaluation of swab B5.

9.47pm: Seah (right) said her presence in court is meant to provide an expert opinion over who was there at the scene of the alleged incident and identify those responsible for it.

10.01am: A journal from the International Society of Forensic Genetics stating the importance for DNA analysts to view drop outs (the alleles not detected) in their reading and findings was referred to by Ram.

Seah who is a member of the society agreed with what is being stated. Ram applied for the journal be marked.

10.28pm: Court resumes after a 10 minute break sought by Ram.

10.39am: Seah agrees that she did not follow the international guidelines set in the International Society of Forensic Genetics, of which she is a member, with regards to what is stated in the journal.

“I did not follow this international guideline, but since it may have changed,” he said.

10.44am: Seah disagreed that she was bias in preparing the report and that she had based it on information given to her.

Ram: Based on international guideline as suggested in this journal, you had not follow or abide by it.

Seah: I disagree.

Judge asks why did Seah did not follow the guideline to which she failed to reply.

11.20am: Ram pointed one allele which was not reported on B9, the low rectal area.

This does not belong to Saiful or “Male Y”. The reading 28 allele is not reported although it has a high peak.

When Ram continue to put this suggestion, the chemist refused to answer.

Ram complained to judge that witness did not want to answer question.

11.27am: Ram suggest that what is reported in the chemist report is what is different from what is seen in graph.

“It seems half a football team’s DNA is found but you chose not to report as it is detected on the underwear, trousers and B5 peri-anal area and now B9,” said Ram.

11.49am: Seah verified that she did not found any stains on the carpet and blue duvet which she received from the crime scene.

These items were earlier tendered as evidence.

11.56am: Seah said she does not know who is male Y, the DNA found on Saiful’s peri-anal, high rectal and low rectal.

“There is no specimen or reference sample provided,” she said.

Ram suggested as to the other unidentified male it could be anyone including the investigating officer Jude Blacious Pereira.

12.08am: Court in recess. Hearing resumes at 2pm with the cross-examination on Seah.
