This morning P.Uthayakumar attended the PJ Magistrates Court before Magistret Puan Latifah bt Ibrahim.
Having detained Uthayakumar’s client for five long days, Chief Inspector Halijah today applied for another 7 days remand on the flimsy grounds that the Chemist Report and Medical reports are not ready. And the usual lame excuse that the victim would be interfered with. Worst still that the DPP is on leave. So a mere suspect and innocent until proven guilty detainee has to remain in jail until the 99.6% more inefficient police get their act together.
Despite submitting an interesting position of remand prisoners in the United Kingdom may be of some relevance here.
In Civil Liberties, Cases and Materials by Bailey Harris and Jones at page 88 Paragraph 3 the writer has outlined a very interesting piece of statistic.
“The Royal Commission on Criminal Procedure found that about 75 per cent of suspects were dealt with within six hours and about 95 per cent within 24 hours. A survey done by the Metropolition Police for three months in 1979 showed that only 0.4 percent of 48,343 persons had been held for over 72 hours without charge or release.”
In Malaysia we are far from achieving the aforesaid standards.
Article 5 of the Federal Constitution is being violated by the racist Malay-sian police this police mindset Magistrate like most other Malay-sian Magistrates give their Omnibus Remand Orders as a matter of course.
In fact the Police, the Magistrets, the Doctors, Chemist and the Attorney General are all on one side versus the poor sole Indian poor detainee.
On another matter where 8 Indian youths were detained for alleged theft of shoes from their factories despite one magistret giving a Remand Order for only one day, the colonial era Sergeant Danial Mohamad behind the lawyers’ back and without informing the lawyer on record got another two days remand because of his inefficiency that he could not complete “investigations:.
And despite the Remand Order expiring at 9.00 a.m this morning these youths have not been produced in a Court of Law or released.
Because in this country Polis is Raja Di Malay-sia and they do so with impunity.
And knowing that 99.9% of the especially poor Indian detainees would not sue the police for false imprisonment and malicious prosecution, they go on abusing the Federal Constitution and the law with impunity.
